1. Definitions
For the purposes of these Terms and Conditions, the following definitions apply:
"Service" refers to heritage property rental services, property viewings, cultural documentation, and related services provided by Aurelis.
"User" or "You" refers to any individual or entity accessing our website or utilizing our services.
"We", "Us", or "Our" refers to Aurelis, a property management company registered and operating in Bangkok, Thailand.
"Property" refers to any residence within our heritage property portfolio, including Decorated Traditional Homes, Contemporary Thai Interpretation properties, and Heritage Art Estates.
"Residence Agreement" refers to the formal contract governing property rental between Aurelis and the resident.
"Website" refers to aurelioesal and all associated pages, content, and functionality.
2. Acceptance of Terms
By accessing our website, submitting inquiries, or utilizing our services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Aurelis. If you do not agree with any part of these terms, you must not use our website or services.
You confirm that you are at least 18 years of age and have the legal capacity to enter into binding agreements. If you are accessing our services on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.
We reserve the right to modify these Terms and Conditions at any time. Changes become effective upon posting to our website. Continued use of our services following changes constitutes acceptance of modified terms.
3. Service Description
Aurelis provides property rental services specializing in Thai heritage residences. Our services include property information provision, viewing arrangements, cultural documentation, residence facilitation, property management during residence periods, and cultural orientation support.
Property availability is subject to change without notice. Information provided about properties represents our understanding at the time of publication but may not reflect current conditions. We recommend property viewings to verify details important to your decision.
Service availability is limited to Bangkok, Thailand and surrounding areas. Properties are offered subject to ownership agreements and may be withdrawn from availability at property owner discretion.
4. User Responsibilities
Users of our website and services agree to the following responsibilities:
Information Accuracy
You must provide accurate, complete, and current information when submitting inquiries or entering into residence agreements. You are responsible for updating information as necessary to maintain accuracy.
Lawful Use
You agree to use our website and services only for lawful purposes and in accordance with these terms. You may not use our services in any way that violates applicable local, national, or international law or regulation.
Prohibited Activities
You may not attempt to gain unauthorized access to our systems, interfere with website operation, transmit malicious code, use automated systems to access the website without permission, copy or reproduce website content without authorization, or use our services for fraudulent purposes.
Property Respect
During property viewings and residence periods, you must respect the cultural significance of properties, follow provided guidelines for handling decorative elements, comply with property-specific rules and protocols, and treat properties and their contents with appropriate care.
5. Intellectual Property
All content on our website, including text, graphics, photographs, logos, documentation, and software, is owned by Aurelis or licensed to us and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes related to evaluating or utilizing our services. This license does not include the right to reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit our content.
Property documentation, including cultural information and historical context provided during residence, remains our intellectual property and may not be reproduced or distributed without written permission.
6. Payment Terms
Rental rates are quoted in Thai Baht and are subject to change based on property availability, seasonality, and other factors. Rates displayed on our website are starting rates and may not reflect final pricing for specific rental periods.
Payment terms are established in individual Residence Agreements. Generally, payment is required in advance of residence commencement. Accepted payment methods include bank transfer, credit card, and other methods as specified in residence agreements.
Security deposits may be required for Heritage Art Estates and other properties containing significant collections. Deposit amounts and refund conditions are specified in Residence Agreements.
All fees and rates are exclusive of applicable taxes unless otherwise stated. You are responsible for any taxes, duties, or charges associated with your residence.
7. Cancellation and Refund Policy
Cancellation terms are established in individual Residence Agreements and vary based on property type, rental duration, and advance notice provided. General cancellation policies are as follows:
Cancellations made more than 60 days before residence commencement may be eligible for refund less administrative fees. Cancellations made 30-60 days before commencement may incur penalties of up to 50 percent of total rental amount. Cancellations made less than 30 days before commencement may result in forfeiture of full rental amount.
Aurelis reserves the right to cancel residence agreements due to property damage, ownership changes, or other circumstances beyond our control. In such cases, alternative properties may be offered or full refunds provided.
Force majeure events, including but not limited to natural disasters, government restrictions, or public health emergencies, may affect cancellation and refund terms. We will work with residents to find reasonable solutions in such circumstances.
8. Property Condition and Maintenance
Properties are provided in good condition suitable for residential use. We make reasonable efforts to ensure properties meet described standards, but cannot guarantee that properties will be free from minor defects or maintenance issues.
Residents must report maintenance issues promptly. We will address reported issues in reasonable timeframes, prioritizing matters affecting safety or habitability. Non-emergency maintenance may be scheduled at mutually convenient times.
Residents are responsible for damage to properties or contents beyond normal wear and tear. Costs for repair or replacement of damaged items will be charged to residents. Heritage Art Estates may have specific liability provisions for collection items.
Regular inspections may be conducted during residence periods to verify property condition and ensure preservation of cultural elements. Reasonable notice will be provided for scheduled inspections.
9. Disclaimers
Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that our website will be uninterrupted, error-free, or free from viruses or other harmful components.
While we strive for accuracy in property descriptions and cultural documentation, we make no warranties regarding the completeness, accuracy, or reliability of information provided. Property conditions may change between information provision and actual residence.
We do not provide professional advice regarding cultural artifacts, art valuation, or architectural preservation. Information provided is for educational purposes and should not be relied upon for professional decision-making without independent verification.
Residents are responsible for obtaining appropriate insurance for personal property and liability. We maintain property insurance but this does not cover residents' personal belongings or liability for property damage.
10. Limitation of Liability
To the maximum extent permitted by law, Aurelis shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services, including but not limited to loss of profits, data loss, or business interruption.
Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
These limitations apply regardless of the legal theory upon which liability is based, whether in contract, tort, negligence, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.
Some jurisdictions do not allow exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Aurelis, its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of our services, violation of these terms, infringement of any third-party rights, or any damage to property or injury to persons caused by your actions during property viewings or residence periods.
This indemnification obligation survives termination of your use of our services and continues for claims arising from actions taken during your use of services.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
Before initiating formal legal proceedings, parties agree to attempt resolution through good-faith negotiation. If direct negotiation does not resolve the dispute within 30 days, parties may pursue mediation through a mutually agreed mediator in Bangkok.
Nothing in these terms shall prevent either party from seeking injunctive relief or other equitable remedies in cases of intellectual property infringement, breach of confidentiality obligations, or other matters where monetary damages would be inadequate.
13. Termination
We reserve the right to terminate or suspend your access to our website or services at our discretion, without notice, for conduct that we believe violates these terms, is harmful to other users, or is otherwise objectionable.
Residence agreements may be terminated by either party in accordance with terms specified in individual agreements. Early termination by residents may result in financial penalties as specified in cancellation policies.
Upon termination, you must cease all use of our services and website. Provisions of these terms that by their nature should survive termination shall continue in effect, including intellectual property rights, disclaimers, limitation of liability, and dispute resolution provisions.
14. General Provisions
Entire Agreement
These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Aurelis regarding use of our website and services, superseding any prior agreements or understandings.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver
Failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Aurelis.
Assignment
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations to any party at our discretion.

Notices to Aurelis should be sent to legal@aurelioesal. We may provide notices to you via email to the address you have provided or through posting on our website. You are responsible for monitoring your email and our website for notices.
